Terms of Service

By accessing and using Gosby ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Gosby.

Gosby is a messaging application that provides AI-powered companions ("Buddies") that can send you personalized updates and engage in conversations based on your selected interests. Buddies proactively message you about topics you care about, creating a conversational way to stay informed.

To use Gosby, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up-to-date

You must be at least 13 years old to use Gosby. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

You agree not to use Gosby for any unlawful purpose or in any way that could damage, disable, overburden, or impair the service. Specifically, you must not:

• Attempt to gain unauthorized access to any part of the service
• Use the App to harass, abuse, or harm others
• Transmit any viruses, malware, or harmful code
• Interfere with or disrupt the App or servers
• Reverse engineer or attempt to extract source code
• Use automated systems to access the App without permission

Gosby offers both free and premium subscription tiers ("Gosby Pro"). Premium subscriptions are billed through the Apple App Store or Google Play Store.

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
• You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription
• Refunds are subject to the policies of Apple or Google, as applicable
• Prices may change with notice; continued use constitutes acceptance

All content generated by Gosby AI Buddies is provided for informational and entertainment purposes only. You acknowledge that:

• AI-generated content may not always be accurate or complete
• You should verify important information from authoritative sources
• Gosby retains all intellectual property rights to the App, including design, code, and AI models
• You may not copy, modify, or distribute any part of the App without permission

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Gosby is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be uninterrupted or error-free
• AI-generated content will be accurate, complete, or useful
• The App will meet your specific requirements
• Any errors will be corrected

To the maximum extent permitted by law, Gosby and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of profits, data, or goodwill.

You agree to indemnify and hold harmless Gosby, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms in the App or sending you a notification. Your continued use of Gosby after such changes constitutes acceptance of the new Terms.

We may terminate or suspend your access to Gosby at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

The following additional terms apply to any App obtained through the Apple App Store:

14.1 Acknowledgement

You acknowledge that these Terms are between you and Gosby (operated by chinnovations.nl) only, and not with Apple Inc. ("Apple"). Gosby, not Apple, is solely responsible for the App and its content. Apple has no obligation to furnish any maintenance or support services with respect to the App.

14.2 Scope of License

The license granted to you for the App is a limited, non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

14.3 Warranty Disclaimer

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Gosby's sole responsibility.

14.4 Product Claims

You acknowledge that Gosby, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

14.5 Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Gosby, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

14.6 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

14.7 Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

The following additional terms apply to any App obtained through the Google Play Store:

• These Terms are between you and Gosby only, and not with Google LLC ("Google")
• Your use of the App must comply with Google Play's Terms of Service
• Google is not responsible for the App or its content
• Google has no obligation to provide maintenance or support services for the App
• Google is not responsible for addressing any claims relating to the App
